link. ND sued over their duty as a religious employer to have to provide certain forms of contraceptive coverage to students and employees. This may sound similar to the stupid Hobby Lobby decision, but it's actually worse than that. As an actual religious organization, ND already had an exemption to this requirement; what ND was suing over was the requirement to simply fill out the form declaring they were a religious organization and therefore exempt. they felt that simply filling out the form made them complicit in the provision of birth control.
their attorney (a former ND football player) got raked over the coals by Judge Posner during oral argument: ?Would you stop babbling?? he told Kairis. ?When you?re asked a question ? you?re not supposed to interrupt judges and, if they ask questions which can be answered yes or no, you answer yes or no. Don?t you understand that??
