the only mitigating factor here would be if he was in the wrong place... (and the mitigating factor in being that stupid would be he was drunk... so it's a catch-22). or maybe he was breaking in to warn the occupants of a fire or something???

if he really did break into a house, i.e. commit burglary, regardless of the other intent, this is the worst offense of the bunch. worse than a DUI.
