well, okay. his record looks... okay.
orrin hatch's statement made me think of that scene in Ghostbusters where they all try not to think of any thoughts, but Ray thinks up the marshmellow man.
you can just imagine all the Republicans on the judiciary committee thinking "nobody give him a name, please god, nobody give him a name..." then hearing a loud collective groan when Orrin says "well merrick garland would be a good choice, not that obama will nominate him."
of course it looks OK to you - the New York Times placed Garland to the left of Supreme Court Justice Elena Kagan, way to the left of Justice Stephen Breyer and minimally to the right of Justices Sotomayor and Ginsburg. The LA times wrote "“If the late Justice Antonin Scalia, a staunch conservative, is replaced by a moderate-to-liberal Justice Garland, the court would tip to the left on several key issues, like abortion, affirmative action, the death penalty, gun control, campaign spending, immigration and environmental protection.”
Yet both of these publications led stories with headlines identifying Garland as a centrist.
My favorite part about these discussions is how you and sbee don't think it's "judicial activism" when the liberal justices vote the left's side on EVERY single issue yet it is when Scalia (who broke ranks with conservatives way more than any liberal justice has with the left) and others vote the right way.
