Roberts is the swing vote

that is surprising... figured it would be Kennedy.

Kagan should have recused herself due to her work on this while part of the Obama Administration.

Thomas should have recused himself, and should be impeached, as a result of his and his wife's tea party activism against the law and generally.

all in all, this supreme court, with the exceptions of Sotomayor, Ginsburg, Breyer, and Kennedy... is a borderline abomination.

Scalia is a total clown... and Thomas is just awful. Abe Fortas was forced out for much, much less. But that is the double standard you see if you fall on the "wrong side" of the power structure.

Yup!!! I called my father-in-law and he called Scalia a criminal...LOL he said that the Right leaning court has been trying to strike down the new deal piece by piece for years.. He really thinks Obama leans more right then people think, and he said the real outcome of the election will be the justice appointments in the next 4 years..

I am so freaking tired of all the hate in this country... fear, fear, fear.. You are so right M..
 
Sort of surprising given how much effort Bush put into getting activist judges appointed during his administration.

I've already heard one claim that Roberts only voted that way to boost Supreme Court credibility.

I think that's a little ridiculous. Any number of things could be going on, but after some of their more god-awful rulings, I don't think "credibility" is a concern that's on his radar. if it was, he'd have pushed Scalia and Thomas in front of a bus already.

agreed--a lot ridiculous. SCOTUS is no place to fuck around. Justices are appointed politically but they form their own personalities (see Kennedy). This was no tit for tat. We assume party line, but that's too simple an explanation.

I never wished death upon him. I simply express an idea that nobody would be said if it occurred. But I like what you did with my words there.

not me. When he used the show "24" to justify torture committed by or on the U.S.'s behalf, that might've been the all-time low for the public discourse. I was shocked to think a Supreme Court Justice could be that ignorant and sleazy. Scalia is a mutant brute, and a complete disgrace to our country (in Italian: disgraziato)

there has been heavy speculation that Roberts wrote both the dissent AND the majority opinion, AND they included some obvious errors (such as referring to Ginsburg's concurrence as a dissent, meaning she had originally been on the losing side). if true, this is unprecedented; would indicate some strange behind the scenes maneuvers at the 11th hour.

I think you're right about the commerce angle; it certainly didn't expand the gov'ts power in this regard.

however, I don't think congress will ever repeal this law, even if the GOP takes both houses and the presidency: their corporate masters in the healthcare industry have already adopted it, and like it just fine. all the complaining on their end is just because "Obamacare" is a useful political football to kick around.

it already has that "dog whistle" effectiveness that politicians love. Just say the word "Obamacare" and conservatives get all hot and bothered. it's brilliant, actually...
