The gun was given to the 5 year old for his birthday.
5 year old
And why is a gun manufacturer producing models for kids?
I'm not suggesting you have to be old enough to drive in order to own a gun, but I don't think that is unreasonable.
5 year olds might get a BB gun (though I don't think those should be given to kids under 8, maybe even 10), but not a .22. Then there is the fact the ammunition was either already loaded in the gun or within very easy reach of the kid.
Shooting and death were ruled "accidental". Sorry, we need to create a new category for these deaths. Maybe "unnecessary", or "negligant". Oh wait, that's right, "negligance" is already an option. When will the police start charging the parents with "negligant homicide" in situations like this? The boy should be taken into Child Protective Services due to Child Endangerment, IMHO.
Preventing 5 year old kids from owning guns is NOT a violation of their Constitutional Rights anymore than not allowing someone to smoke cigarettes until 18 or drink until 21 is a violation. Those ages are in place for the safety of not only the individual, but society in general. Guns manufacturers have no business creating guns designed for children. Toy guns, sure, I don't have an issue with that. BB guns, yeah, you can shoot an eye out and those are sad stories in their own right, but it is difficult to justify removal of BB guns. There is zero reason for children to have actual guns.
Of course these types of changes will never happen due to the NRA and the Gun Lobby having too much hold in Congress. I get that is the reality at the moment, but there will come a time when the vast majority of US Citizens demand a change to protect the children. These shootings are not the result of a Mental Disability, they are the result of Parents doing the wrong thing.
The saddest part is the kid didn't shoot and kill the mother, IMHO.
