The local District Attorney has turned it over to the Grand Jury.

That was the status as of about a week ago.

grand jury proceedings are notoriously opaque, and all sorts of evidence can be introduced that may be excluded at trial. This could be bad news for Tony Stewart... or it could be a whitewash to allow NASCAR to save face.

yeah... he/she is probably not looking forward to charging Tony Stewart, as DA's are obsessed with their win/loss record (ethics and justice be damned).

But I don't believe he had to turn this over to the Grand Jury; he could've simply declined to press charges with nothing more.

Wasn't the guy who died local? Maybe his family and friends successfully pushed them to do more. Maybe the DA figures with the weight of the grand jury behind him, this case has a better chance of succeeding. On the other hand, it could better publicly absolve Stewart if a Grand Jury declines to return an indictment.

Tantillo said "two dozen" people were interviewed in the case and revealed that toxicology reports determined that Ward had marijuana in his system.

"There is toxicology evidence in the case related to Kevin Ward, that actually indicated at the time of operation that he was under the influence of marijuana," Tantillo said. "There was no toxicology work performed on Tony Stewart, however a certified drug recognition expert had interviewed him on the night of the collision and determined that he found no basis to observe any alcohol consumption or impairment by drugs."

So there's another lesson to be learned about the d's and don't's of race car driving.

1 ) DO stay in your car if disabled until help comes and assists you out safely.

2 ) DON'T attempt to physically take on a fast moving approaching vehicle.

3 ) DON'T get stoned before the race.

When asked about Ward's toxicology reports, Tantillo said that the amount in his system was "enough to impair judgment."
