"[Matthew] McLaughlin, who submitted the "Sodomite Suppression Act" ballot initiative proposal with the required $200 fee, was not immediately for available for comment.The lawyer's address registered with the proposal is in Huntington Beach, south of Los Angeles in Orange County, known as a Republican stronghold in otherwise overwhelmingly Democratic and socially liberal California."
I get that most people who live in Orange Co. would be proud to hand their local government to the Nazis if they could, but still you gotta figure this guy would be more comfortable being a Florida attorney, or a South Carolina attorney... not a CA attorney.
 
I think such a statute would be in violation of federal civil rights laws.

Plus I don't think it stands much of a chance of getting passed.

it would be Unconstitutional with a capital U, that's for sure, but unconstitutional laws are passed all the time, and remain on the books until some good-for-nothing liberal lawyer jerk challenges them.

Orange County, man. what a place.

Do you think they would start executing the gays prior to judicial review? Or would they hold off giving the court system a chance to have its say?
 
Been saying for a couple years that we should institute biblical law. Quickest way to a voluntarily atheistic country.

well anyone charged with the crime would presumably still have a right to trial (but maybe this psycho's ballot proposal does away with that as well?), and hopefully their attorney would be competent enough to challenge the Constitutionality of the statute at some time prior to trial, and appeal it all the way to the US Supreme Court if need be.

CA does have a lot of wacky lawyers though, since you can sit for the bar exam there without going to an accredited law school.

although these days, even going to an accredited law school isn't saying much, since the Third/Fourth Tier Toilet Law schools of the world basically allow anyone in who is not a convicted murderer, regardless of LSAT score. But I digress...
