Beats his pregnant girlfriend......allegedly........wonder how Goodell handles this. I say he tries to make up for the Rice fiasco and suspends him for a year.

These guys are gonna have to have every aspect of their lives videotaped. I don't feel bad for the guilty in any way....hope McDonald gets everything he deserves....if guilty, of course.
 
I don't follow these events that closely.

Does Goodell hand down suspensions before the accused have had their legal due process?
 
I don't think the NFL needs to wait for legal due process.

Does that mean he does typically does it?

I don't know anything about the charges. I don't know if there documented injuries, or if there are witnesses, etc.

He was arrested and is out on bail, to my understanding, that might be enough. But to my understanding the NFL can do what they choose.

Is there a report on if the woman is injured? Did she call the police, or were they responding to reports of a disturbance?
 
According to the new rule it should be 6 games AFTER he is convicted. Union blows if the suspension is longer than the rule states on a first offense the first time they are enacting it...why even have a rule then?

Supposedly other members of the 49'ers were present, and according to some reports witnessed him hitting her, but did not intervene.

Goodell can hand down suspension in this case, as he did with Ray Rice although Rice was not criminally charged.

According to the new domestic violence rules, the first offense is six games, and the second is a lifetime ban, but there are conditions which can escalate a first offense into a lifetime ban or a longer ban such as the player being involved in an incident of domestic violence before entering the NFL, use of a weapon, or if the woman is pregnant or the act is done in front of a child.

Sources have said Goodell will not suspend a player unless their case is adjudicated. So if they don't take a plea and aren't found guilty, he won't suspend, but he can. There is no rule in place to prevent him from acting without the courts.

Since this was a pregnant woman, and only two days after the new rule passed, it will be interesting to see if Goodell hits McDonald with a lifetime ban, or if he acts without the courts involvement, just to send a message.

The players union has promised to block any suspension in which the player did not have due process first, but technically speaking, they are powerless here, as they gave Goodell the right to enforce the code of conduct policy of the league in the last three CBAs. The length and nature of any suspension for this is entirely his discretion, and the courts would agree with him.

Even player friendly judges like David Doty won't override the league in a case like this.

Nope, ruling states it can be elevated to a lifetime ban if the woman is pregnant, and she is.
 
Since police just said they are not releasing the 911 tape, because only the victim and her family have the rights to it, I would say she called the cops, and that's how they got involved.

This apparently happened at his birthday party, in front of a lot of witnesses. He was help without bail, which is odd in a DV case, so I am guessing witnesses gave an account that convinced a judge this man was not only likely to be convicted, but had the means and resources to flee.

I would be surprised if it was anything less than lifetime, with the right to request reinstatement after a year. And he won't be a member of the 49'ers anymore if the stories of Harbaugh's stance on DV is what the players say it is. Unforgivable was the word I heard used the most.
 
I think rice was convicted on a plea deal.

Nope, the prosecutor dropped the charges since there was no evidence of a crime.

The only person who could testify against Ray Rice was his fiance, and he married her. A wife cannot be compelled to testify against her husband, so the case died on the DA's desk.

He was offered a plea, but turned it down and married the girl instead.

He'll full on cut him. Sometimes guys get falsely accused, but that doesn't seem to be the case here. Injuries and witnesses; the guy musts did it.

The NFL seems to be getting closer to NASCAR in that they have "rules", but choose if/when/what/how to enforce infractions.

I don't know why the 49ers don't pick up Michael Sam.

That dude will never put his hands on a woman in his life.

That's either bullshit or Harbaugh isn't a man of his word, Ahmad Brooks cold clocked a chick in 2008 but hes on the 9'ers roster. Then again, maybe he wont forgive you, but he will still start you.
