He was an awful jurist, and a disgrace to Italian Americans.

I wonder if Obama could possibly get a nominee in? I say go for it!

In my opinion it's better to replace a conservative with a conservative. Having too many that go one way or the other is not good.

ScaIia was one awful justice. Less conservative justices would be better and Obama should nominate one if he choses to..
 
Sadly the conservative right lead by obstructionist himself Mitch McConnell has said they will block anyone nominated by Obama for 11 months.

If they block a reasonable appointment for an entire year, I bet Congressional Republicans come away looking like morons incapable of governing in the eyes of most Americans (kinda like the government shutdown) and hurt at the polls in 2016 as a result.

The RNC knows that they need to play to moderate republicans in this election, especially with the split with Trump and Cruz. Creating a massive obstruction could disillusion those voters (think government shutdown angry), and thus they'd be shooting themselves in the foot come November (especially with so many contested congress seats at stake). Second, whether they like it or not, Bernie or Hillary could be in the White House, thus increasing the likelihood of a much more liberal nominee. Congress might just hem and haw a bit, and scoot through a more moderate liberal, rather than taking that chance.
 
I love that they said they would block any appointee but they don't even know who the appointee would be. We don't know who he or she is but we hate her already.

I also love how republicans complain about activist judges until it comes down to legislation they don't like.
 
I'd say there's probably a pretty good chance the next appointee is going to be a liberal activist just like his first two, so saying they're going to oppose isn't telling anyone anything they don't already know.

Scalia was an activist? Do you know the difference between an activist and a Federalist? You see judges are supposed to uphold the Constitution, not agenda driven identity politics. It's actually the left that's always screaming about partisan votes every time they lose a case.

Anyway, he was one of the greatest SCJs of all time - a truly great American. Rest in peace Justice Scalia.

What's a reasonable appointment? Neither of Obama appointments has been even close to what anyone would call a moderate.

the GOP controls the Senate, and they're the ones who approve Supreme Court appointments.

I've read a couple similar articles along those lines, that if they hold up this appointment for the entire year, it will hurt them in November.

Who knows? I'm sure they will attempt to paint whoever he appoints as a "dangerous liberal" in order to justify their actions. For the percentage of "Dumbass Americans" out there, i.e. Spartanracist & his ilk, it won't matter; Obama is by definition a radical socialist islamofascist, so whoever he appoints will be one too, by extension. No need to even think about it!

It probably will hurt them at the polls, especially assuming he'll appoint someone from among the ranks of Federal appellate court judges, all of whom have been appointed and confirmed before, vetted by our right-of-center federal government, and with a decade plus of jurisprudence under their belt, allowing people capable of thinking, i.e. not Spartanracist and his ilk, to review their cases and opinions and decide for themselves if they are a dangerous liberal islamofascist, or whatever.

GOP better be 1000% confident in winning the presidency because I get the feeling HRC/Bernie's choice is going to be further from the middle than Obama's choice.

One of most conservative justice of all time on most lists. No wonder you like him so much. 29+ years on the bench is way to long for any justice. This crap shit Roberts court needs a shake up. 10 years should be the limit for each judge.

I honestly couldn't tell you, I don't keep up with Circuit Court appointments. But I've seen several lists of potential nominees floating out there already.
